A decade later, the PCLOB held its first public meeting, which mostly served to show how far the board still is from being capable of carrying out its intended functions. Read More »

Senate Report Says DHS Fusion Centers “Wasted Money and Stepped on Civil Liberties”

In a lengthy and scathing report, the Senate Committee on Homeland Security’s Permanent Subcommittee on Investigations concluded that the fusion centers “forwarded intelligence of uneven quality — oftentimes shoddy, rarely timely, sometimes endangering citizens’ civil liberties and Privacy Act protections, occasionally taken from already published public sources, and more often than not unrelated to terrorism.” Read More »

How Will the “Hate Caucus” Fare in this Election?

AAI is continuously tracking key congressional races across the country. One trend AAI is tracking closely is whether or not the electoral tide will turn against candidates who espouse hate speech and Islamophobia. With just over a month until the election, it appears as though many of Congress’s most notorious Islamophobes stand a good chance of losing their seats and that several challengers who have turned to bigoted rhetoric are unlikely to be elected. Read More »

Orange County Mosque Spying Case Highlights Need for State Secrets Reform

It is a disturbing trend that the federal government possesses near limitless power to end litigation with the mere assertion that they were acting in secret in the interest of national security. It is especially troubling when cases involving the basic constitutional rights of American citizens have been violated. The state secrets privilege also has a well-documented history of abuse, as it is more often than not used to shield government agencies from embarrassment or revelations of gross misconduct. This is most likely the case with “Operation Flex.” Read More »

Is Romney Embracing the Islamophobic Fringe?

Earlier this week Republican presidential candidate Mitt Romney was pointedly asked whether he would condemn Michele Bachmann’s witch-hunt against Arab American and American Muslim public servants. Romney refused, saying “I’m not going to tell other people what things to talk about. Those are not things that are part of my campaign.” This refusal to show leadership is troubling, but was dismissed by many as simply the former governor attempting to avoid controversy.  Read More »

Federal Court Delivers Key Ruling on Secretive “No Fly List”

Over two years ago attorneys with the ACLU filed suit on behalf of 15 clients, including 4 U.S. military veterans who had been erroneously placed on the government’s “No Fly List.” Each of the 15 learned that they had been labeled as terrorist threats only when they were stopped from boarding planes. The lawsuit on their behalf argues that placing citizens on the No Fly List without providing them any opportunity to confront and rebut the decision or any evidence against them is unconstitutional. Since filing the suit, it has been a struggle for the case to even get its day in court. Read More »

Russell Pearce’s Emails Prove Racial Motivation for SB-1070

The ACLU of Arizona released obtained thousands of emails from the office of recalled Arizona State Senate President Russell Pearce, related to the controversial Arizona immigration law SB-1070. While many, including the Department of Justice under President Obama, have tried to divorce issues of racial profiling from discussion of the bill’s merits and legality, Pearce’s emails reveal a deep-seated racial motivation for his authorship of Arizona’s immigration law. Read More »
